By agreeing to the terms and conditions of The Sim House by NW Golf Guys (NW Golf Guys, Inc.), I acknowledge that the Golf Simulators offered by NW Golf Guys may expose participants and participant’s guests to dangers and risks.
ACKNOWLEDGMENT OF RISKS: I acknowledge that I am entering a facility where golf balls are driven and golf clubs are swung at high speeds, frequently exceeding 100 miles per hour. I acknowledge that golfing (including simulator use), and related activities at The Sim House, present, carry and involve a serious risk of physical injury to both active participants and spectators. By entering The Sim House, located at 2548 NW Upshur Street, I do so at my own risk.
RELEASE AND INDEMNITY: I hereby release NW Golf Guys, Inc. and their respective affiliates, subsidiaries, officers, directors, employees, and agents (hereafter referred to as "Releasees") from any and all claims, actions, damages, costs, and expenses, including attorney's fees, as a result of or arising from my participation or my guests participation in the recreation activity on property owned, managed and/or controlled by Releasees, including, but not limited to, personal injury, property damage or wrongful death. THIS INCLUDES, WITHOUT LIMITATION, ANY CLAIMS, DAMAGES OR ACTIONS ARISING OR RESULTING FROM THE ORDINARY NEGLIGENCE OF RELEASEES.
ASSUMPTION OF RISK AND LOSS: I hereby agree to waive any and all such claims and declare that this Waiver and Release is to be binding upon my heirs, executors, administrators and assigns. Further, I hereby agree to release and discharge the Releasees from any loss or theft of, or damage to, personal property. I FULLY UNDERSTAND THAT I FOREVER GIVE UP ANY RIGHT TO SUE OR MAKE A CLAIM AGAINST THE RELEASEES IF I OR MY GUESTS SUFFER INJURY OR DAMAGE EVEN THOUGH WE DO NOT KNOW WHAT OR HOW EXTENSIVE THE INJURY OR DAMAGE MAY BE. I HEREBY PERSONALLY ASSUME ALL RISKS WHETHER FORESEEN OR UNFORESEEN IN CONNECTION WITH THE ACTIVITY OR ANY ACTIVITIES INCIDENTAL THERETO. I FULLY UNDERSTAND AND AGREE THAT THESE TERMS ARE CONTRACTUAL AND NOT A MERE RECITATION AND THAT I HAVE VOLUNTARILY SIGNED THIS DOCUMENT.
I agree to pay for any damage caused by myself or my guests to any equipment or fixtures at the NW Golf Guys facility or in the NW Golf Guys member lounge. I also acknowledge that security cameras are recording all inside activity and that I will be held liable for any theft that occurs while checked into the facility under my member account. I understand that NW Golf Guys reserves the right to cancel my tee time and/or membership at any time.
